GALLOPLASTIK vs MEGAPLAST

Recently, many of our customers and suppliers have contacted us concerned about obtaining information regarding a communication concerning Galloplastik, published on Megaplast’s website. Unfortunately, this forces us to clarify Galloplastik’s current position on this issue.

On July 28th, 2022, Megaplast published the following statement on its website:

“In November 2020, MEGAPLAST Industrial – Exporting S.A. filed a lawsuit against GALLOPLASTIK S.R.L., on the grounds of EP1768837 patent right infringement. We believe that MEGAPLAST enjoys the exclusive rights for perforated packaging films as claimed in EP1768837, whereas third parties are prohibited from selling or offering for sale products making use of the subject matter of EP1768837 without our consent (see Art 64 (3) European Patent convention).”

This information was deliberately disclosed by Megaplast for the sole purpose of unjustly discrediting Galloplastik’s products and reputation.

Here’s what Megaplast “forgot” to communicate:

On May 9th, 2022, two months before its statement, the consultant of the Court to which Megaplast had turned to establish the violation of its patent by some products of Galloplastik, had reported to the Judge and also to Megaplast that:

Megaplast’s patent EP1768837 was not valid.

None of Galloplastik’s products interfered
with Megaplast’s patent EP1768837.

For these reasons, we have already warned Megaplast to refrain from such deliberately partial and misleading statements. We therefore invite you to distrust of anyone who continues to spread news about alleged patent infringements by Galloplastik and, in case this happens, please, promptly inform us so that we can protect our rights and yours against those who practice unfair competition based on intimidation and defamation.
